TERMS AND CONDITIONS
The www.camisahomevillas.com portal (the "Web Site") is owned by CAMISA HOMES & VILLAS SRL with registered address in Florence (Italy), 50129 viale Spartaco Lavagnini n.70, VAT No. IT03738021207. (hereafter referred to as “CAMISA”). These General Terms and Conditions govern the use of www.camisahomevillas.com Web Site by the users and constitute a binding agreement between CAMISA and the individual user ("User"). By your access to and use of any of the services on this Web Site, you become a User of its services. By accessing the Web Site and using specific services you agree to accept and abide by the Conditions of Use and the specific terms associated with all services available. By your access to this Web site, you will be deemed to have acknowledged and agreed to its Terms. Subsequent use of the Web Site will constitute acceptance of the modifications by the User. Users who do not agree to be bound by these Terms, should promptly discontinue their use of the Web Site.
1) FEATURES AND SERVICES OF THE WEB SITE
The Web Site features various types of properties located in Italy ("Properties"), for which rental agreements may be stipulated with CAMISA entitled to offer them for rental. The Web Site offers Customer Users the opportunity to purchase ancillary services offered by third parties, including, but not limited to, cleaning of the property, as well as other services to be provided on request. Customer Users may further purchase ancillary services in connection with the rental through the same procedure, together with the stipulation of the rental agreement.
2) RENTALS
CAMISA is authorised to act as a booking agent to contract rentals on behalf of the owners of the properties. Some properties may have a minimum rental period or a specific day of the week as arrival (i.e. Saturday). This information is mentioned on the unit price list.
In case of rentals longer than 30 nights, a written contract (in Italian Language) to be signed bt both parties is obligatory as per Italian law. Eventually a half cost of the registration fee of 2% of the full amount plus 30€ stamps (minimum 67€) is to be paid by the client.
3) RENTAL PRICES
The rental prices are divided by season and are meant per unit per period.
All extra charges (mentioned in the description of each property) are not included in the rental price and are to be paid directly to the owner of the property or to his/her representative on arrival at the property unless otherwise agreed in writing at the time of booking. The prices are an integral part of these general conditions of rental.
3A) MINIMUM PRICE GUARANTEE. CAMISA guarantees that the prices published through its pages are the lowest available on the market. If the clients should find (for the same dates, at the same conditions, and for tariffs in euros) a lower price with a competitor, the client will be entitled to a discount by CAMISA equal to the difference between the prices released by CAMISA and the ones published by the competitor. Only exception is a difference lower or equal to € 50 in total on the published prices (always referring to the conditions mentioned above).
4) HOW TO BOOK
All bookings must be made directly through CAMISA or agencies, which are authorised to act on behalf of DIMORE. These agencies can also accept payments from the client on behalf of CAMISA . The client must fill in the booking-form and accept these general conditions.
A deposit of 30% of the total rental is due at the time the booking is confirmed. The balance is due no later than 45 days prior to arrival at all the villas and all properties with stays longer than 30 nights, or only 10 days prior to arrival at the Florence apartments short terms. If the balance is not paid within this time limit, CAMISA reserves the right to cancel the booking.
Possible exceptions to above payment terms are mentioned under the property description.
Upon receipt of the balance CAMISA will provide the client with a rental voucher with the address and directions to the property and the instructions for gaining access to it.
Upon arrival the client must show the voucher to the owner of the property or to his/her representative before gaining admittance to the property. No other document will be accepted. The voucher is personal and valid only for the persons named on the booking form and it is non-transferable. The owner or his/her representative will refuse entrance to the property if the number of persons exceeds the number mentioned on the voucher. If there is any change in the total number persons during the stay, CAMISA must be informed in advance, otherwise the owner or his/her representative can request the whole party to leave, in which case the client will have no entitlement to any refund of the rental payment or associated charges.
All changes and special requests must be agreed in advance with CAMISA. Children under the age of 2 can stay at the properties free of charge and are not counted in the number of persons booked to stay at the property, provided that the client brings his/her own baby-cot and linen (possible exceptions are pointed out on the property description).
5) PAYMENT
Payments must be made in cleared funds by bank transfer (SWIFT) or by credit card (VISA, MASTERCARD or AMERICAN EXPRESS). For payments made by bank transfer the name of the client, the booking number and the property reference must be clearly specified. Payments in other currencies than Euros (€) are not accepted.
6) ARRIVAL AND DEPARTURE
The client must arrive at the property between 16.00. and 19.00 (possible exceptions are mentioned on the property description). Any change to the arrival times must be advised to CAMISA during normal office hours (from Monday to Friday from 9.00 to 13.00 and from 14.00 to 18.00 and from Easter to Oct. On Saturdays from 16.00 to 20.00) prior to arrival and are subject to the approval of the property owner.
In case of unexpected late arrival, the client must advise CAMISA (and moreover) the owner directly. Should the owner or his/her representative not to be able to accept a late arrival, all associated costs incurred by the client (including without limitation) hotels, restaurants, travel are to be borne by the client. Should the owner or his/her representative be obliged to wait for customers after the agreed time, he/she may request a late-arrival fee.
Upon arrival the client must produce to the owner or to his/her representative the rental voucher and passports of all members of the party in order to conform to the Italian Law. Only guests whose passports are registered are allowed to stay in the property. If there is any substitution of persons during the stay, the owner or his/her representative can request the whole party to leave, in which case the client will not be entitled to any reimbursement or compensation. In addition, possible extra charges included local tourist taxes where requested can be deducted from the security deposit.
The clients must depart on Saturday between 8.00 and 10.00 (possible exceptions are mentioned on the property description), after returning the house keys and allow the owner or his/her representative to inspect the condition of the property.
7) REFUNDABLE SECURITY DEPOSIT
Upon arrival the client must pay a security deposit as guarantee for possible damages and/or extra charges which are not included in the rental price.
The deposit is to be paid in euros (€) (cash payments unless otherwise indicated) as per the amount indicated on the voucher to the owner or his/her representative. The owner or his/her representative has the right to refuse admittance to the property if the deposit is not paid, in which case the client will not be entitled to any reimbursement or compensation. This deposit will be refunded on departure after deducting possible damages and/or extra charges not included in the rental price. If the amount of possible damages is higher than the security deposit, customers must pay the difference to the owner or his/her representative before departure.
In the description of the property, may be indicated that the security deposit is to be paid to CAMISA (at least 3 days before arrival) rather than to the owner on site. In this case, security deposit will be returned within 7 days after departure minus any damages and / or extra expenses not included in the rental price
C AMISA is not responsible for any disputes between the client and the owner concerning the security deposit.
8) CLEANING
Upon arrival the client will find the property in clean and tidy condition. At departure the client must pay to the owner or to his/her representative final cleaning charges unless it has been specified that these are included in the rental price. It is the client’s responsibility to ensure that the property is left in the same condition of cleanliness and repair as upon arrival. The costs incurred by the property owner resulting from any failure by the client to maintain the property will be deducted from the security deposit.
9) UTILITIES
Utilities (Internet connection, Electricity, Water, Heating, Air-conditioning if provided) are mentioned on the property description and pricing. If not clearly stated a included in the Price, their costs must be paid on the spot to the owner of the property or to his/her representative and can be calculated depending on the use, in which case the property description will read "according to consumption".
In Italy the use of heating (period of use, temperature…) varies from region to region. At the time being in Italy the use of heating is allowed in the period from Nov. 1st to March 30th 8 hours a day. The possibility of using the heating outside this period and the cost of it must be agreed with the owner of the rented property. The properties without the symbol referring to the heating are not provided with a heating system.
10) PETS
Domestic animals (cats and dogs) are allowed only in the properties showing the “flag” referring to domestic animals. At the time a booking is confirmed the client must advise CAMISA of any domestic animal (indicating size and breed) so CAMISA can inform the owner of the property.
The property owner may request an extra charge for accepting a pet. If so, this supplement will be mentioned on the property description and must to be paid on site.
The customer must look after his/her pet in order to avoid possible damages and / or any disturbance to other guests.
11) BEHAVIOUR
The client renting a CAMISA property is responsible for his/her correct behaviour whilst occupying the property. Should a client fail to behave in a civilised and decent manner, the owner or his/her representative has the right to ask the client and their party to leave the property immediately and may deduct from the security deposit such sums as are necessary to repair any damage and cover any related costs. In these circumstances the client will have no entitlement to any refund of the rental payment or associated charges.
If the amount of possible damages is higher than the security deposit, customers must pay the difference to the owner or his/her representative before departure.
IMPORTANT
It is absolutely forbidden to access (for any reason) the rented property with a number of guests higher than the maximum property capacity It is also strictly forbidden to organize parties, birthday parties or events in general without the approval of the owner.
Is mandatory to dispose of rubbish during and at the end of the stay. If rubbish is found in the house at the end of the stay, a penalty of €300 will be charged, which will be deducted directly from the deposit.
12) EXTERNAL MAINTAINANCE
The owner or his/her representative reserves the right to enter the property for essential maintenance works (garden, swimmingpool, etc.) even in case of independent villas or units.
13) INSURANCE
It is a condition of these general terms that the client has sufficient insurance cover for the duration of the booking.
14) COMPLAINTS
The description of the properties are made in good faith. CAMISA cannot be held responsible for changes carried out by the owner of the property without noticing CAMISA.
If the client has any complaint in the property, he/she should inform CAMISA on the arrival day and confirm it in writing within 24 hours (CAMISA offices are open from Monday to Friday from 9.00 to 13.00 and from 14.00 to 18.00 and from Easter to October on Saturdays on the following number: +39 327 629 1524.
Complaints will not be accepted unless this procedure is observed. CAMISA reserves the right to verify, during the period of occupancy, the reasons of the complaint of the client, if necessary by inspecting the property. If the complaint is accepted, the client will be compensated in proportion to the extent of the sustained damage (up to a maximum of the rental price).
If necessary, CAMISA reserves the right to move the client to a similar or to a better property, subject to availability. If the price of the alternative accommodation is lower than the price of the booked house, CAMISA will refund the client the difference between the initial price and the rate of the alternative accommodation.
If the price of the alternative accommodation is higher than the price of the booked property, the difference will be not be charged to the client. Should the client accept this exchange, no further compensation will be payable to the client.
If no alternative property is available, CAMISA will refund the total rental. In no circumstances will DIMORE pay or be liable for any hotel or other accommodation costs.
If a client leaves a property without giving CAMISA the possibility of verifying the reason of complaint, the client looses the right to any compensation or refund. If a client complains when he/she is no longer on the rented property, he/she looses the right to any compensation or refund.
CAMISA will not accept as causes for complaint weather conditions, stings or presence of insects, lack of utilities (internet, water, electricity, heating), work in progress, etc., if these depend on state-run organisations, and anyway do not depend on CAMISA or Property Owner.
CAMISA properties are not hotels but private homes. Their equipment, furniture and characteristics reflect the local style, the taste of the owner and the Italian or local traditions (ex.: normally the coffee machine is the Italian espresso maker and not the electrical machine) and do not reflect the standard grading used by hotels. Therefore CAMISA will not consider these elements as a cause of complaint.
15) CANCELLATION
Should the client for any reason cancel the booking, the following cancellation charges will be applied (all cancellations must be confirmed in writing to booking@camisahomevillas.com):
- 30% of the total rental if the cancellation is made after booking time.
- 100% of the total rental if it is made 45 days or less prior arrival in a villa or for stays longer than 30 nights in any property, or only 10 days prior to arrival for the Florence apartments short terms.
Possible exceptions to above cancellation policy are mentioned under the property description.
For stays over 60 nights the following cancellation charges will be applied
- the down- payment paid at booking time if the cancellation is made after booking time.
- one month's rent if the cancellation is made 45 days or less prior arrival day, or in case of no-show.
Our cancellation policy is applied to both full and partial cancellations of any booking which has been confirmed. Please note that the minimum stay for Properties must be respected in case of partial cancellation (i.e., if a property has a minimum stay of 7 nights, and the client has booked for 7 nights, he cannot cancel 2 nights and request a refund for those nights).
In case of long-term rentals (over 61 days), client, who would like to end the rental period in advance, must provide a 60-day advance notice to avoid paying any cancellation penalties.
For any amendment to the original booking, if the property and the rental period do not remain the same, the booking has to be cancelled applying the above cancellation fees, and a new booking is necessary. Should DIMORE succeed in renting the property of the cancelled booking, the client must only pay a penalty equal to the actual damage sustained by CAMISA.
The rental price does not include cancellation insurance.
Should CAMISA be forced to cancel a booking because of reasons outside of their control, CAMISA will, subject to availability, offer a similar or a better property. If the price of the alternative accommodation is lower than the price of the booked house, CAMISA will refund the client the difference between the initial price and the rate of the alternative accommodation. If the price of the alternative accommodation is higher than the price of the booked house, the difference will not be charged to the client. In case no other alternative accommodation is available, CAMISA will refund the total price of the booking and no further compensation will be due to the client.
COVID-19 CANCELLATION POLICY As per actual Italian Law
For all bookings with arrival up to December 20th. 2024 the following cancellation policy applies:
If in presence of government restrictions on travels in Italy, or towards Italy,from the traveller's country of origin during the rented period, it will be possible to cancel the reservation free of charge starting from 14 days prior arrival.
In this case, CAMISA will reimburse the traveler the paid amount (excluding any booking fees) or will provide a voucher (for the amount paid) to be used for a future booking of same amount.
16) INTELLECTUAL PROPERTY
All content published on the Web Site - or accessible through it - is protected by legislation on copyrights and industrial property. Users are not authorized to reproduce, modify, decode, circulate, copy, and disseminate above-mentioned information and contents absent the express prior permission of CAMISA.
17) JURISDICTION
These terms and conditions are governed by Italian law. Any disputes arising from these Terms, any bookings and/or the use of the Web Site by Users shall be subject to the exclusive jurisdiction of the Florence City Court, Italy.
18) DATA PROTECTION
DIMORE may use your personal data (as defined by the Data Protection Act 1998) for the purpose processing bookings and providing services, client identity and verification, the administration of files and records, legal and regulatory compliance and the marketing and promotion of services, as well as informing clients of relevant news.
Please note that we will need to share information to property owners as part of the booking process. You have the right to access personal data we hold about you. If you do not wish us to process your personal data for marketing purposes, please advise us in writing as soon as possible. All data submitted to the Web Site is treated in accordance with our Privacy Policy, accessible in the Privacy section of the Web Site.
